The above said Pomeranian is sold as a PET for the total price of _______________. A deposit of _________________(250.00 minimum) is hereby made and the cash balance is due to Seller before this dog is placed in the Buyer’s possession. Registration papers will also be held until the balance is paid in full. The Buyer understands that once a deposit is made, it is a commitment to buy said dog and is therefore NONREFUNDABLE. Buyer will forfeit deposit and said dog may then be re-sold if not paid in full by specified date being____________________. Checks will be accepted for deposit only the puppy will have to be paid for in full by cash, moneygram, or western union before puppy can be taken home.
IT IS HEREBY AGREED BY BOTH PARTIES THAT THE FOLLOWING CONDITIONS WILL BE MET AND THAT NO OTHER WARRANTIES OR CONDITIONS ARE EXPRESSED OR IMPLIED.
If this dog has been sold as PET it does not qualify as a show prospect at this time of sale. This dog is being sold with FULL _______LIMITED_______registration.
(Limited registration means that offspring of this dog CANNOT be registered.)
Seller guarantees this is a purebred POMERANIAN, offspring of the above named dam and sire.
Buyer certifies that he/she is not acting as an agent for another individual in the purchase of this dog, and will not sell this dog to any mass-producing kennel, puppy mill or business.
The purchaser promises to keep the dog in a proper manner. It shall not be kept permanently in a kennel. If problems arise concerning keeping or training, or if the dog becomes seriously ill, the BUYER agrees to consult the Breeder. If it should prove necessary for the dog to change hands the Breeder has prior purchase rights for a limited period of two weeks. Selling to a third party is permissible only after prior consultation with the Breeder, whereby the main consideration is the assurance that the dog is passed to responsible owners. This puppy has been bred by us and has been carefully and painstakingly reared. The parent animals were mated with the aim of breeding good and healthy puppies. Seller guarantees this dog to be free of communicable diseases as appears to the eye at the time of sale.
At the expense of the BUYER, this dog should be examined by a licensed veterinarian with in 48 hours of possession to validate Health Guarantee. (If purchase is on Saturday, this requirement is extended through the following Monday) Should this dog be found in ill health, the cause of which is clearly attributable to the Breeder, this dog may be upon written diagnosis from a veterinarian, be returned to Seller for refund of purchase price, or for another dog of equal value, the choice to be determined by the Seller.
No other warranties are expressed or implied unless explained by Seller below:
Buyer releases Seller________________________________and their estate from any and all liabilities, and/or damages by fault of this dog after the time of the sale. These damages include but are not limited to destruction of property, and /or physical damage to any person or group of people.
This contract is made out in duplicate: The Seller and The Buyer each to receive a copy.
